Terms of Service

The Japanese version of these Terms is the authoritative version. The English version is provided for reference only; in case of any discrepancy, the Japanese version prevails.

These Terms of Service (“these Terms”) set out the conditions for using Kirokka (“the Service”). By using the Service, you (“the User”) are deemed to have agreed to these Terms.

1. Scope

These Terms apply to all relationships between the User and the operator regarding the use of the Service.

2. Intended Use

The Service is provided for individual, personal use. You may not resell or redistribute the Service to third parties, or provide another service built on top of the Service, or engage in any similar act.

3. Use by Minors

If you are a minor, please use the Service only with the consent of a parent or legal guardian.

4. Prohibited Acts

When using the Service, the User must not:

• Violate any applicable law or public order and morals
• Interfere with the operation of the Service
• Reverse engineer, decompile, or disassemble the Service
• Gain unauthorized access to, or otherwise improperly interfere with, the Service’s systems
• Infringe the rights of other users or third parties

5. Disclaimer

1. Records in the Service are, in principle, stored locally on the User’s device. The operator is not liable for any loss of data resulting from the loss, damage, or reset of a device, deletion of the app, or any other cause, beyond the limit set out in paragraph 3 of this Section. Users are responsible for backing up their own data using the export feature provided by the Service or other means.
2. The operator does not warrant that the Service is free of factual or legal defects.
3. In light of the Service being provided free of charge, except in cases of intentional misconduct or gross negligence by the operator, the operator’s liability for any damages arising from the Service is limited to JPY 0.

6. Intellectual Property

All copyrights, trademarks, and other intellectual property rights related to the Service belong to the operator or to third parties who lawfully hold such rights. Users must not infringe these rights except as expressly permitted under these Terms.

7. Changes to or Termination of the Service

The operator may change the content of the Service, or suspend or terminate its provision, without prior notice to Users. The operator’s liability for any resulting damages is limited as set out in Section 5, paragraph 3.

8. Distribution Through the Apple App Store

The iOS version of the Service is distributed through Apple Inc.’s App Store. In addition to these Terms, Apple’s standard End User License Agreement (EULA), as registered in App Store Connect, applies to your use of the Service. If these Terms and Apple’s standard EULA conflict, Apple’s standard EULA prevails to the extent of the conflict. Apple is not a provider of the Service and is not responsible for any support, maintenance, or warranty for the Service.

9. Changes to These Terms

The operator may revise these Terms to the extent reasonable in light of the necessity and appropriateness of the change. In that case, we will announce the revised content and its effective date by a notice on this website (together with a notification within the Service or other means, as needed) before that effective date, and will replace these Terms on this website with the revised version on the effective date. The revised Terms take effect from the announced effective date. However, a change that is in the general interest of users may take effect when it is announced, such as by posting on this website.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any dispute arising from the Service shall be subject to the jurisdiction of the Tokyo District Court as the court of first instance.
